Succesful property purchase in Italy

 Once you’ve found a home you want to buy, the next step is to make an offer, usually through an estate agent. There are no restrictions on foreign ownership in Italy.

Offer:

When you find the right property in Italy you can place an offer. If the offer is accepted by the owner of the property, Abruzzo Rural Property will collect all the document related to the house.

The most important documents are:

  • Titles documents
  • Floor plans and land maps
  • Energy certification

There might be other documents required by the notary. We will provide to the notary all the documents he asks for. The notary will check all the documents, if everything is in order he will issue an estimate. The estimate will include: Notary fee, purchase taxes, registration taxes.

When the notary gives his approval, and issues an estimate the buyer can choose to have a technical survey. The survey is not a mandatory document, it is not required by the notary. Nevertheless, the buyer might want to have it to be sure about the state of house. A survey can be provided by any registered surveyor, architect or engineer.

Preliminary agreement:

At this point after the approval of the notary and after the satisfactory outcome of the survey if the buyer decides to have one done, Abruzzo Rural Property can proceed to write a preliminary agreement.

The preliminary agreement is a pre-purchase contract where we will state:

  • Terms and conditions of the purchase
  • Buyers and vendors’ data
  • Property cadastral data
  • Price of the property

The preliminary agreement must be registered at the Agenzia delle Entrate to be an official contract. If the preliminary agreement is not registered, it’s value is reduced to a mere agreement amongst two people. When the buyer and the vendor will both have signed the preliminary agreement, the buyer must send a deposit of the 10% of the final purchase price. The deposit can be sent directly to the owner of the house or to the real estate agency that is handling the sale.

Usually the completion’s time after the signing of the preliminary agreement is two or three months. It is possible to complete the sale in shorter time or longer time according to buyer’s and vendor’s need. The terms of the sale will be stated in the preliminary agreement and will have to be respected. The preliminary agreement can be signed from abroad and sent by email. But two original copies with original signatures will have to be posted to Abruzzo Rural Property that will take care of the registration process.

Final Signing - Deed of sale:

The final signing will take place at a notary office here in Italy. To sign the final deed the buyer will have to be present, or he will have to sign a power of attorney in favour of the real estate agent or any other people who can attend the signing.

On the day of the final signing the buyer must complete all the payments: to the owner of the house, to the notary and to the agency.

On the date of the final signing the buyer will receive the keys of the house and will become the new owner of it.

In Italy only fully licensed real estate agents can work in the real estate business. The license can be obtained after a 12 month formation course held by the local Chamber of Commerce. At the end of the course, two exams are to be taken there and only after passing these exams, will it be possible to apply for a license.

Passing real estate exam to get license

The license will only be granted to those with no criminal record and to those with an insurance to cover all work related to problems that might occur. For example, if a client were to fall whilst visiting a property, the insurance of the fully registered realtor might well cover the damages.

It is also very important to have full trust in a registered realtor for another reason: When there is a formal written offer and the buyer sends a deposit to the real estate agency or to the owner of the house, the realtor has to register the contract at the local tax office.

Registration is required by Italian law. Without it, buyers and sellers could incur in a fine and in the worst case, the buyer could lose his/her deposit and also the property. A purchase offer or a preliminary agreement not registered at the local tax office, is not an official document. It is just a piece of paper without any legal value.

The registration makes the contract official and public; Through this document the government knows that the property is going to be sold to the buyer and therefore the owner of the house will not be able to sell the property to anyone else, even if he were to receive a better offer. This is obviously a safeguard for the buyer. Only regularly registered real estate agents can guarantee the registration of a contract.

Italian law is very strict on this matter and only registered realtors can show properties to potential buyers. A foreign buyer looking for property in Italy, might come across people who introduce themselves as licensed realtors but who are not actually registered at the Chamber of Commerce and therefore are not insured. This could be very risky. This type of “false” realtor usually deals with foreign buyers as, in many cases, foreigners are not familiar with the Italian law and are not aware that realtors need to have both a license and an insurance.

Today on the internet, there are numerous websites of real estate agencies selling properties in Italy, many of which are written only in English. Some of them are fake real estate agencies or fake realtors.

An Italian real estate agency’s website should show:

  • The license number  (Not the VAT number, the VAT number is a different thing).
  • The insurance number
  • The association to a business category
  • It should be written in Italian (not only in English)

If you are dealing with realtors who do not show their license, do not hesitate to ask them for credentials…. It is better to be safe than sorry.

Buying a house in Abruzzo

 We too would like to share our experience of, not only buying in Italy but also the very smooth process of buying through Abruzzo Rural Property and, in particular, our Agent, Monia.

My cousin and I have Italian blood running through our veins and so it was only natural that we both wanted to have our own little getaway in Italy if only to get back to our roots.

 We therefore started our search in early 2015 and saw 12 houses over two days before falling in love with our beautiful house in the small village of Tufillo with its breathtaking scenery and warm, welcoming people.

The “buying” process went so smoothly because we were in such safe hands with Monia. The way she just dealt with everything for us, from negotiating with the owners, signing the papers, meeting with the Notario, to handing over the keys and introducing us to our wonderful builders, in such a calm manner was just so helpful and we could not have done it without her. Everybody going through a similar process should have a “Monia” supporting them as you will not find anyone more efficient and professional than she is. She even took us to the bank to help us open up an Italian bank account – would we get that service from a property agent in the UK?  I don’t think so!

From Iceland to Abruzzo: Why I bought a house in Colledimezzo?

 Our real estate agent Monia asked us if she could blog about us and the house on the hill in the little fairy village of Colledimezzo.

Of course it is our pleasure to share with everyone our experience of how it is to have one foot in Italy and one in Iceland. In our opinion Abruzzo is "a slice of heaven", we just love it!

We love the wonderful villages and the breathtaking views, the friendly people and their healthy attitude to life. The fresh and tasty food, its absurdly good. The lovely clean beaches that are not to crowded plus of course that which is most important for us Icelanders the good weather.

The first word you learn in Italy is "con calma" or slow down, in the beginning that was very difficult for two over stressed Icelanders!

We probably looked like mental patients to the villagers when we run up and down all the infinitely many steps from the house up to the bar many times a day even during the hottest hours of the day when no one was outside, to check out our e-mail and facebook status (the only internet connection is at the bar). In between painting doors, windows, walls and of course all the endless cleaning.

It's a good thing that I can speak Italian so that our dear neighbors, could tell us often enough to calm down, for us to actually learn to relax more and enjoy the moment.

When we first started looking for a summer house in Italy, I was very negative to search for a house in Abruzzo, the only thing I wanted to view was Toscana and preferably Florence. I accepted to go to Central Italy and see the villages just to please my husband.

I am very glad that I did !!

The first time we came to Colledimezzo it was raging rain through the whole time. Monia showed us the house that was going to be our summer house.

I strongly disliked it, I told my husband I will never go back to this house! I just don’t like it... luckily he did not listened to me, and took lots of photographs for me to view when we got home. Needless to say I fell completely in love with the house and the village.
