Technical survey: Is this necessary to buy a property in Italy?

 Numerous clients have asked me this question: Is a technical survey required by the law in order to purchase a house in Italy?

The answer is no. For the Italian law a survey is not a mandatory document in order to buy a house.

A survey is a document you might want to have for your own peace of mind, to give you a better idea of the state of a property you are interested in, but it is not necessary for the sake of the purchase.

In Italy there are three different types of surveys:

  • Perizia semplice – If you are buying a house in Italy, you might want a technical survey to be carried out as a form of report on the condition of the house: conditions of the structure, roof, plumbing, electric system, condition of chimneys, etc. Any registered architect, surveyor or engineer can issue this type of survey; This type of survey is called perizia tecnica in Italian. The surveyor signs the survey with his/her own name.
  • Perizia asseverata – This type of survey is different from the previous one because the surveyor/engineer/architect signs the technical report and in addition confirms the authenticity of its contents. Perizia asseverata includes a sentence where the surveyor declares that the contents of the survey are true and that he/she is personally responsible for these contents. The sentence in Italian is the following: “sotto la propria personale responsabilità”. In this case, the surveyor is legally responsible for the contents of the survey he/she has issued and can be legally persecuted if the survey were to contain false statements related either to material or ideological matters.
  • Perizia giurata – This type of survey is like a perizia asseverata plus an oath in court. The surveyor has to state in the survey that the contents are true and he/she has to swear the truthfulness of such contents in the presence of a Chancellor of the Court, in the presence of a Peace Officer according to art. 5 del R.D. n° 1366/22, or in the presence of a Public Notary, according to art. 1, comma 1, point n° 4, R.D. n° 1666/37. The surveyor is legally responsible for the contents of a perizia giurata and can be legally persecuted if the survey were to contain false statements. In this type of survey, the surveyor has to state the following sentence: “[...]aver bene e fedelmente adempiuto all’incarico affidatogli al solo scopo di far conoscere la verità.”. This means that he/she has done his/her work honestly with the sole purpose of divulgating the truth. This type of survey has a higher legal value in a court case than a perizia asseverata.
